Ambassador Legal Disclaimer

 

This Ambassador Legal Disclaimer ("Disclaimer") is made and entered into by and between The Farmery Group Inc., its related entities, DBAs, and owners ("Company") and any individuals or entities participating in ambassador promotion or ambassador programs including but not limited to those with the title Wavemakers with the Company ("Ambassadors"). By engaging in ambassador promotion or ambassador programs, Ambassadors agree to the following terms and conditions:

 

1. Non-Liability of the Company: Ambassadors expressly understand and agree that the Company shall not be held liable for any actions, claims, damages, or losses arising out of or in connection with the ambassador promotion, the Company's products or services, or any transactions initiated through ambassador referrals.

 

2. Independent Relationship: The relationship between the Company and Ambassadors is that of independent contractors. Ambassadors are not employees, agents, or legal representatives of the Company, and nothing in this Disclaimer shall be construed as creating a partnership, joint venture, or employer-employee relationship.

 

3. Ambassador Responsibilities: Ambassadors are solely responsible for their marketing strategies, promotions, and advertising materials. Ambassadors agree to comply with all applicable laws, regulations, and industry standards in their marketing activities.

 

4. Commission Disclaimer: The determination of Ambassador commissions is solely at the discretion of the Company. The Company reserves the right to establish and modify commission structures, rates, and eligibility criteria at its sole discretion. The decision-making process may consider various qualifications, performance metrics, and specifications set forth by the Company. Ambassadors acknowledge and agree that commission rates, structures, and qualifications are subject to change without prior notice. The Company may provide information regarding the commission criteria, but such details are indicative and may be adjusted by the Company at any time. Ambassadors are encouraged to review the official communication channels, program documentation, or contact the Company directly for the most up-to-date information regarding commission structures and eligibility criteria. By participating in the Ambassador program, Ambassadors acknowledge their understanding of the Company's discretionary authority in commission-related matters and agree to abide by the terms outlined in this disclaimer.

 

5. No Warranty or Guarantee: The Company makes no warranties, representations, or guarantees regarding the potential income, success, or results that may be achieved through ambassador promotion. Earnings and outcomes are subject to various factors beyond the Company's control.

 

6. Indemnification: Ambassadors agree to indemnify, defend, and hold harmless the Company from any claims, liabilities, damages, or expenses, including legal fees, arising from or related to the Ambassador's activities, promotions, or breach of this Disclaimer.

 

7. Modification and Termination: The Company reserves the right to modify, suspend, or terminate the ambassador program, its terms, and this Disclaimer at any time, with or without notice, at its sole discretion.

 

By participating in the Company's ambassador program, Ambassadors acknowledge that they have read, understood, and agreed to be bound by this Disclaimer.
